Terms of Use

Welcome to Very Mary Piano Studio! These Terms of Use (“Terms”) govern your access to and use of our website, verymarypianostudio.com (hereafter referred to as "the site")  including booking piano lessons, purchasing sheet music, and engaging with our blog or other content. By accessing or using the site in any way, you agree to these Terms. If you do not agree, please do not use the site.

 

1. Acceptance of Terms

Using the site in any way, for example, browsing, booking lessons, or purchasing products, constitutes your acceptance of these Terms and our Privacy Policy. You must be at least 18 years old to use our services without parental consent.

 

2. Use of the Site

You agree to use the site lawfully and for its intended purposes (e.g., booking lessons, purchasing sheet music). You may not:

  • Violate any laws or regulations.

  • Interfere with the site’s functionality (e.g., hacking, introducing viruses).

  • Copy, distribute, or modify our content without permission.

  • Conduct yourself in any fraudulent or misleading manner while using or interacting with the site.

  • We reserve the right to suspend or terminate access for any violation of these Terms.

3. Liability

You use the site at your own risk. Very Mary Piano Studio, including its content, services, and third-party links (e.g., embedded blog content), is provided “as is” without warranties, express or implied. We are not liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages, arising from your use of the site, to the fullest extent permitted by law.

4. Account Security & Responsibility

It is your responsibility and you agree to keep your account login credentials (e.g. user name, password etc) confidential and secure. It is your responsibility to notify us immediately if your account security has been breached.

5. Intellectual Property

All content of the site, including text, images, sheet music, blog posts, and logos etc, is owned by Mary Barton (DBA  Very Mary Piano Studio) or licensors and is protected by Canadian copyright and intellectual property laws.  You may not  reproduce, distribute, or create derivative works without our written permission.

6. Purchases of and No Refunds on Digital Sheet Music 

  • All sheet music sold  on the site is via digital download only (PDF format). No printed copies available on this site.

  • Digital sheet music purchases are final, non-refundable and non-exchangeable due to their non-returnable and copyable nature.

    • Please take advantage of any product previews, including audio or video clips, available on the site to review products you are interested in before purchasing, and read any product descriptions provided. If you require further information about a product, we'd be happy to answer your questions via our contact form or email.

    • Please ensure items and quantities in your cart are correct before completing your purchase.

  • Download links for sheet music remain valid for 30 days and may not be shared with others. It is your responsibility to ensure the email address you supply us with for your download access is accurate. 

  • Payment or download troubleshooting: Contact us via our contact form and we'll respond promptly.

7. Sheet Music Licenses

  • SINGLE-USER LICENCE means it is for the personal use of the purchaser only or a single person it was purchased for, and cannot be reproduced in any format for others.

    • You may print ​your purchased digital sheet music for your own personal use, but you may not make copies, in whole or part, for others or distribute in any way. 

    • You may purchase multiple copies of a sheet music product. For example if you want a copy for yourself and one for a friend, you need to purchase 2 copies.

    • You may store the PDF on your computer or similar device, but you may not share, distribute or transfer it to others.

    • You may not post the sheet music in whole or part online (e.g. on social media), except in accordance with fair-use laws and purposes.

    • You may not alter the sheet music or PDF in any manner.

  • STUDIO-LICENCE means that if you are a TEACHER, you may not only use the material for our own personal use and enjoyment, but you may also use the sheet music with any students that you directly and currently teach.

    • You may not share it with former students.

    • You may not share it with other teachers, even if they are in the same studio. Each teacher must purchase their own studio-licensed copy.

    • You may not use it for school classrooms - please direct inquiries regarding obtaining a classroom licence to info@verymarypianostudio.com

    • PDF's may be shared with online students only, and on the condition that they do not share the PDF or reproduce the sheet music in any format for others.​​ 

    • You may not charge students for copies of the sheet music, except for actual printing costs incurred, provided there is no markup. 

    • You may not resell the sheet music to students or anyone else

    • If you are not a teacher, the conditions of the single-user licence applies to you and you may not reproduce or distribute the sheet music for others in any format, nor share the PDF with others. 

    • You may not alter the sheet music or PDF in any manner.

  • AI (ARTIFICIAL INTELLIGENCE) PROHIBITED: You may not use the sheet music in whole or in part nor in any format with any AI or similar system or technology for any purpose whatsoever. (See AI policy for more details)

8. Third-Party Services and Links

The site may include links or embedded content (e.g., in our blog). These third-party services or other third-parties that may be associated with the site, such as Google Analytics, have their own terms, and we are not responsible for their content or practices. Review their terms before engaging.

9. Dispute Resolution

Any disputes arising from these Terms or your use of the site will be resolved through binding arbitration in Winnipeg, Manitoba, Canada, in accordance with the rules of the ADR Institute of Canada. Arbitration will be conducted in English, and the arbitrator’s decision is final. You waive the right to pursue class actions or court proceedings, except where prohibited by law.

 

10. Termination

We may terminate or suspend your access to the site at our discretion, without notice, for conduct that violates these Terms or harms our operations, users, or third parties.

 

11. Changes to These Terms

We may update these Terms to reflect changes in our services or legal requirements. The updated Terms will be posted on  the site with a new effective date. Continued use of the site after changes constitutes your acceptance.

 

12. Governing Law

These Terms are governed by the laws of Manitoba, Canada, without regard to conflict of law principles.
